This is a petition for grant of regular bail to the petitioners in case FIR No. 272 dated 17.8.2015, registered under Section 379 & 34 IPC (Sections 379-B, 411 IPC and Section 25/54/59 of the Arms Act, 1959 were added subsequently), at Police Station Civil Lines, District Amritsar City.

Learned Deputy Advocate General has filed custody certificates of the petitioners by way of affidavit of Ravinder Kumar Sharma, Superintendent, Central Jail, Amritsar. The same are taken on record.

Criminal Misc. No. M-37222 of 2015 Learned counsel for the petitioners argued that apart from the merits of the case, the petitioners have now been in custody for one month and 20 days each and the matter is triable by Magistrate. Learned State counsel has not been able to deny the factual averments made above.

Without commenting upon merits of the case and keeping in view the period of custody undergone by the petitioners, I do not deem it appropriate to deny them the concession of bail. Thus, the present petition is allowed and the petitioners are ordered to be released on regular bail to the satisfaction of the Chief Judicial Magistrate/Duty Magistrate, Amritsar.
