The petitioner has filed this petition under Section 438 Cr.P.C. for grant of anticipatory bail in case FIR No.151 dated 3.10.2014 registered for the offences under Sections 406 and 498-A IPC at Police Station Mataur, District S.A.S. Nagar (Mohali). Notice of motion has been issued in this case. Mr. S.S. Chandumajra, learned Deputy Advocate General, Punjab has put in appearance on behalf of the respondent-State and Mr. Krishan Kumar Goel, learned Advocate has appeared on behalf of complainant-respondent No.2 and contested this petition. Criminal Misc. No.M-37316 of 2014 [2] learned counsel for the complainant-respondent No.2 and have gone through the record.

The complainant-respondent No.2, who has filed affidavit through counsel deposed that the matter has already been settled and the petitioner as well as the deponent are going to file a petition under Section 13-B of the Hindu Marriage Act. At the time of arguments, it is stated by the learned counsel for complainant-respondent No.2 that the complainant has no objection if the interim order granting bail to the petitioner is made absolute.

Keeping in view the facts and circumstances of the present case, and the fact that the petitioner has already joined the investigation and in view of the affidavit regarding compromise filed on the record, I find sufficient ground to accept this petition specially in view of the compromise between the parties. Therefore, the interim order dated 03.11.2014 passed by this Court granting interim bail to the petitioner is made absolute. However, the petitioner shall join the investigation as and when called upon to do so and shall abide by the conditions of Section 438 (2) Cr.P.C.
