Versus
Union Territory, Chandigarh and another ......... Respondents CORAM: HON'BLE MR. JUSTICE JAGMOHAN BANSAL Present :
Mr.Rajesh K.Dadwal, Advocate for the petitioners.
Mr. Sumit Jain, Addl.PP for U.,T.Chandigarh.
**** JAGMOHAN BANSAL , J. (Oral) The petitioner through instant petition under Section 482 Cr.P.C. is seeking quashing of FIR No.0015 dated 13.01.2022 registered at Women Police Station, Chandigarh, under Sections 406 and 498-A of IPC. Learned counsel for the petitioner inter alia contends that marriage of respondent No.2 was solemnized with son of petitioners No.1 and 2 which was a love marriage and against the wishes of family members of the petitioner, thus, there was no question of dowry. Initially, both the families were against the marriage, however, at the later stage, family of respondent No.2 agreed with the marriage and for the said purpose, matrimonial ceremonies were performed which were not attended by the petitioners.
Mr.Ravinder Rana, Advocate has filed his power of attorney on behalf of respondent No.2, which is taken on record. ANJU GOEL 2023.04.25 17:11 I attest to the accuracy and integrity of this document
CRM-M-20434-2023 -22023:PHHC:058290 Learned State counsel, who is present in Court on advance notice, submits that FIR has been registered against husband of respondent No.2 and petitioners are simply called upon to reply queries of the Investigating Officer and they have not been nominated as accused, thus, present petition is not maintainable.
On being confronted with the afore-stated fact, learned counsel for the petitioners submits that they have already joined investigation, however, they are ready to appear and would appear as and when called by the Investigating Officer.
Without commenting on the merits of the case, the petitioners are directed to appear before Investigating Officer on 02.05.2023 at the first instance and thereafter as and when called through notice under Section 160 Cr.P.C. by the Investigating Officer.
