#$ !% Allegations against the petitioner Shanker Lal in this petition filed under Section 439 Cr.P.C. seeking regular bail in case FIR No.39 dated 26.05.2011 registered at Police Station Bagha Purana, District Moga under Sections 279/337/338/427 IPC, are that being driver of the offending vehicle which caused accident leading to death of the deceased and during the course of trial petitioner had absented on 26.04.2012 and was declared as Proclaimed Offender and subsequent thereto he had surrendered before the Court.    Contentions of the learned counsel for the petitioner that the petitioner is in custody since 04.09.2015 and that the trial is not likely to conclude in the near future could not be controverted by learned State counsel.

Though conduct of the petitioner is not appreciable, however taking into consideration the incarceration already undergone by the petitioner and the fact that the trial will take a long time to conclude, this Court is of the opinion that further detention of the petitioner in the present case is not warranted. Accordingly, he is ordered to be released on regular bail to the satisfaction of Chief Judicial Magistrate/ Duty Magistrate.

The present petition stands disposed off accordingly. $  "
