(ORAL) Prayer in the instant petition under Section 482 Cr.P.C. has been made for quashing FIR No.27 dated 19.05.2018, registered under Section 420 IPC at Police Station Bholath, District Kapurthala (P-1) and all subsequent proceedings arising therefrom, on the basis of compromise deed dated 19.07.2018 (P-2).
Pursuant to order dated 28.11.2018, of this Court, parties appeared before the trial Court on 05.01.2019 for recording their statements. Learned Judicial Magistrate Ist Class, Kapurthala, has submitted her report vide letter bearing No.12 dated 05.01.2019 duly forwarded by learned District and Sessions Judge, Kapurthala, vide Endst. No.42 dated 09.01.2019.
According to the reports, ld. Judicial Magistrate Ist Class, SONIKA 2019.04.05 18:29 I attest to the accuracy and authenticity of this document Chandigarh
CRM-M-38218 of 2018 --2-- Kapurthala, is satisfied that parties have entered into compromise voluntarily and without any threat, coercion or pressure and their compromise is genuine one and both the parties have made statement in the court voluntarily and without any pressure. In compliance of order dated 20.02.2019, original receipts regarding deposit of costs of `15,000/- have also been produced in Court today. The same are taken on record. Be tagged at appropriate place. Considering the report of ld. Judicial Magistrate Ist Class, Kapurthala dated 05.01.2019 and the fact that the compromise will bring peace and harmony in relations between the parties, aforesaid FIR No.27 dated 19.05.2018 along with all subsequent proceedings arising therefrom, is quashed qua the petitioner only.
Disposed of accordingly.
