Heard.

None has appeared on behalf of respondent despite service. Learned counsel for petitioner submits that the petitioner has surrendered before the trial court and has been released on interim bail as per order dated 6.2.2017.

The petitioner was earlier on bail but had not appeared before the court on 29.11.2016. Learned counsel for petitioner submits that it was due to some mis-communication that the petitioner could not appear on that day.

Keeping in view the fact that the petitioner has put in appearance and the trial is in progress, this petition is allowed. The order dated 6.2.2017 is made absolute subject to the condition that the petitioner shall keep on appearing before the trial court on each and every date of hearing; he will not leave the country without prior permission of the court; and in the event of his not appearing in the court, the trial court will be competent to cancel his bail and take him in custody.
