ARUN MONGA, J. (ORAL) Petitioner has approached this Court for grant of anticipatory bail in case FIR No.77 dated 30.03.2021 registered under Sections 379/411 IPC, at Police Station City Ferozepur, District Ferozepur. 2.
Per FIR, a police party was on patrolling duty on 31.03.2021 when a secret informer disclosed that Gurpreet Singh @ Gora along with Neeraj @ Neeri are regularly stealing and selling motorcycles. Gurpreet Singh @ Gora and Neeraj @ Neeri are waiting for the customers/buyers for the stolen motorcycles near Bajaj Dairy, Ferozepur city and if raided, they can be apprehended red handed. Finding the information trustworthy, ruqa was sent and formal FIR was registered. One independent witness, namely, Sukhchain Singh was also joined in the police party.

Learned counsel for the petitioner submits that petitioner has been falsely implicated in the case. The co-accused, namely, Gurpreet Singh @ Gora and Neeraj @ Neeri were arrested from the spot and two motorcycles, SHALINI BHATIA 2021.06.18 21:41 I attest to the accuracy and integrity of this document
on which they were travelling and later found to be stolen, were recovered from then. However, neither the petitioner was present at the sport nor any recovery was effected from him. As per prosecution story, petitioner was named by the co-accused in their custodial disclosure statement, which is not admissible in law. Some stolen motorcycles were allegedly also given to brother of Gurpreet Singh, namely, Manpreet Singh @ Sonu (present petitioner) for selling the same.

Per contra, learned State counsel submits that as many as 27 stolen motorcycles were recovered from the co-accused Gurpreet Singh @ Gora and Neeraj @ Neeri. He further contends that as per the disclosure statement of co-accused Gurpreet Singh @ Gora, who is brother of present petitioner, the petitioner used to sell the stolen motorcycles in market, after forging the documents.

I have heard rival contentions of learned counsel for the parties. 6.
As per prosecution case, the secret informer specifically named the petitioner along with other accused. During interrogation, both the coaccused specifically named the present petitioner as their companion in committing the offence. As many as 27 stolen motorcycles were recovered from the co-accused.

In the premise, taking into account the seriousness of the offence, no ground for grant of anticipatory bail is made out. 8.
Dismissed.
