The petitioner is alleged to have sold 500 gram of opium to coaccused Satnam Singh. Recovery was not effected from the petitioner, as such, the petition is allowed. Interim order dated 25.10.2016 is hereby made absolute subject to all the conditions u/s 438(2) Cr.P.C. A condition is imposed that the petitioner will not indulge in the similar activity, of which he is accused of, during pendency of the trial. In case of any violation, it will be open to the prosecution agency to seek cancellation of this order.
