The present writ petition has been filed under Article 226/227 of the Constitution of India for issuance of an appropriate writ or order in the nature of mandamus directing the respondents to release the pension of the petitioner without any further delay.

Before the commencement of arguments, learned counsel for respondent No.3, at the very outset, submits that the retiral dues of the petitioner have already been disbursed; however, the pension has not yet been released on account of the service book of the petitioner having been misplaced. CWP-9559-2026 of reconstructing the service record and that the pension of the petitioner shall be released within a period of three months. 3.

Per contra, learned counsel for the petitioner submits that he would be satisfied in the event the pension of petitioner along with arrears is released together with interest @ 6% per annum. 4.

In view of the statement made by learned counsel for respondent No.3, the present petition is disposed of with a direction to the respondents/competent authority to release the pension of the petitioner along with interest @ 6% per annum. The interest shall be computed from the date the amount became due, i.e. upon expiry of one month from the date of retirement of the petitioner, till the date of actual disbursement. 5.

Let the aforesaid exercise be carried out and the consequential monetary benefits be released to the petitioner within a period of three months from the date of receipt of a certified copy of this order. 6.

Pending miscellaneous application(s), if any, shall also stands disposed of.
