The petitioner through instant petition under Articles 226/227 of the Constitution of India is seeking direction to respondent No. 2 to issue him passport.

The petitioner applied for passport and was granted appointment of 24.08.2022, however, due to pendency of FIR No. 53 dated 13.04.2017, under Sections 323, 325, 341, 148, 149 of IPC, registered against him at Police Station, Majitha, District Amritsar Rural, his request was not entertained. The police after completing investigation has submitted its report under Section 173 Cr.P.C. wherein petitioner has been declared PARAMJIT KAUR SAINI 2024.04.24 03:34 I attest to the accuracy and integrity of this document

innocent. The petitioner is not involved in any other offence. 3.

Learned counsel for the petitioner submits that case of the petitioner is squarely covered by judgment of this Court in Mohan Lal @ Mohna vs. Union of India and others 2023 SCC Online P&H 1391. 4.

Notice of motion.

Ms. Amrita Singh, Central Government Counsel for Union of India and Mr. Aman Dhir, DAG, Punjab, who on advance notice are present in Court, accept notice and waive service.

Ms. Amrita Singh, Advocate, submits that petitioner has been granted appointment for 30.4.2024 and he may be directed to appear before the passport authority alongwith requisite documents especially with certified copy of challan and the passport authority, thereafter, would pass an appropriate order after considering the afore-stated report within eight weeks.

Learned counsel for the petitioner agrees to the aforesaid arrangement.

In the wake of statement of both sides, the petition stands disposed.
