SATISH KUMAR MITTAL, J. (ORAL) This order shall dispose of CWP Nos.6214 and 6215 of 2003. These two writ petitions have been filed by five persons namely Mohan Kumar, Tarsem Kumar, Kartar Singh, Mohinder Singh and Lakvir Singh. All the petitioners at one point of time had worked as Beldars in the Panjab University Construction Office.

Undisputedly, all these persons had worked for less then 240 days in a calendar year. The petitioners have not challenged their termination under the Industrial Disputes Act, 1947 but have preferred to rush to this Court through the present writ petition. Since these petitions were admitted about a decade ago, learned counsel for the petitioners while referring to the affidavit filed by the Registrar of the University, in compliance of the last order dated 6.2.2014 stating therein that 54 posts of Beldar are still lying vacant in the University and has submitted that the RAJEEV THAKRAL 2015.01.22 16:08 I attest to the accuracy and authenticity of this document High Court Chandigarh

CWP No.6214 of 2003 -2case of the petitioners may be considered for appointment against these vacant posts.

Learned counsel for the respondents very fairly submits that as and when new appointments will be made against the vacant posts referred to in the affidavit, the case of the petitioners will be considered in accordance with law.

In view of the above, the present petition is disposed of with a direction to the respondent-University that as and when advertisement for appointment of Beldars is made, it will be open for the petitioners to apply for those posts and they will be considered for those posts keeping in view their past service with the University, in accordance with law.
