RAMENDRA JAIN, J. (ORAL) Prayer in the instant petition under Section 439 Cr.P.C. has been made for grant of regular bail to petitioner - Sukhdev Singh - in a case arising from FIR No.20 dated 18.02.2017 under Sections 420, 467, 468 and 471 IPC registered at Police Station Patti, District Tarn Taran. Learned counsel for the petitioner inter alia contends that the dispute in between the parties is purely of civil nature with regard to ancestral house measuring 5 marlas. The petitioner being an old aged person is afflicted with age related ailments. He is in custody since 02.09.2017. The son of the petitioner, namely, Malkiat has already been granted regular bail by this Court vide order dated 06.10.2017 passed in CRM-M-32888 of 2017.

On the other hand, learned State counsel has vehemently opposed the above submissions made by learned counsel for the petitioner. Ravinder Singh 2017.10.12 13:03 I attest to the accuracy and authenticity of this document Considering the overall circumstances of the case and the fact that

-2CRM-M-37376 of 2017 the dispute in between the parties is purely of civil nature, the petitioner deserves the concession of regular bail. Thus, without expressing any opinion on the merits of the case and also that the trial is likely to take a long time, the instant petition is allowed treating the case of the petitioner on the same parity as that of his co-accused son, who has already been granted regular bail. Petitioner - Sukhdev Singh is ordered to be released on bail pending trial, subject to his furnishing adequate bail bonds and surety bonds to the satisfaction of trial Court/Duty Magistrate concerned.
