******* SUDIP AHLUWALIA J.(ORAL) The instant petition has been filed under Section 439 of the Code of Criminal Procedure seeking regular bail on behalf of the petitioner in case FIR No. 33 dated 26.04.2016, registered under Sections 302, 148 read with Section 149 of Indian Penal Code, at Police Station Arniwala, District Fazilka, who has remained in detention since 01.05.2016. 2.

Ld. counsel for the petitioner seeks his release basically on the grounds of long detention as well as very advanced age of petitioner who is about 86 years old by now. So in this connection, attention of the Court is drawn to order dated 30.08.2017 passed in CRM-M-28709-2011 viz-a-viz co-accused Preeto Bai, who, also being a very old lady, was ordered to be released on bail. It had also been noted in the aforesaid order that out of the 18 cited prosecution witnesses, only two had been examined till that date, on account of which completion of trial was likely to take substantially a Jyoti 2017.10.13 10:53 I attest to the accuracy and authenticity of this document

It transpires that even till now no other witness from the prosecution has been examined till date .

As such taking into account the age of the present petitioner namely Pritam Singh and long detention suffered by him so far, he may be released on regular bail subject to the appropriate terms and conditions to the satisfaction of the Ld. Trial Court concerned. 5.
