(Oral) Today, at the very outset, learned counsel for the petitioner submits that the FIR came to be lodged under some misunderstanding and that the amount in question was in fact an amount which was to be returned by the petitioner as loan and in respect of which a cheque had been given much earlier which had been dishonoured even before lodging of the FIR. It has thus been submitted that the petitioner may be permitted to withdraw the petition with liberty to apprise the investigating agency/Investigating Officer about the relevant facts.

In view of the submissions made above, the instant petition is disposed of as withdrawn with liberty aforesaid. It shall be open to the MOHAN SINGH 2023.04.26 17:34 I attest to the accuracy and authenticity of this order/judgment
