The petitioner has filed this second petition under Section 439 Cr.P.C. for grant of regular bail in case FIR No.122 dated 04.08.2017 registered for the offences under Sections 364-A, 365 and 34 IPC at Police Station I.T. Park, Chandigarh.
Notice of motion.
Mr. Parveen Chauhan, learned Advocate appearing for Mr. G.D. Wasu, learned A.P.P. has put in appearance on behalf of U.T., Chandigarh and contested this petition.
I have heard learned counsel for the petitioner and learned counsel for the U.T., Chandigarh and have gone through the record. From the record, I find that Amit Kumar-complainant was HARPAL SINGH PARMAR 2018.10.03 16:49 I attest to the accuracy and authenticity of this document Chandigarh
Cr. Misc. No.M-38321 of 2018 [2] kidnapped by four persons. Two accused, namely, Raju Khan and Ashu are named in the FIR. As per the allegations, they demanded `5 Lakhs. Later on, they told the complainant to ask his wife to bring whatever is lying in the house and then `52,000/-, which were lying in the house, were paid. There is also allegation that injuries were also inflicted to the complainant. Keeping in view the facts and circumstances of the present case, nature and gravity of the offences and in view of the fact that there is every chance of tampering with the evidence, I do not find it a fit case where the present petitioner is entitled to the benefit of regular bail. Therefore, finding no merit in this petition, the same is dismissed.
