(Oral) Present petition has been filed under Section 482 Cr.P.C. for quashing of order dated 06.08.2015 (Annexure P-1), vide which the learned Sessions Judge, Ropar has dismissed the revision petition filed by the petitioner for enhancement of interim maintenance. Learned counsel for the petitioner submits that as per salary statement of December, 2014 (Annexure P-6), respondent Ranjit Singh (husband) was getting net payable salary of `24,412/- per month. Moreover, interim maintenance of `4,000/- per month awarded by the learned trial Court, vide order dated 27.02.2015 (Annexure P-2) to his wife (petitioner No.1) and two minor children (petitioner Nos.2 and 3) is insufficient for Naresh Kumar 2017.03.08 15:58 I attest to the accuracy and integrity of this document Chandigarh their survival.
CRM-M-37353-2015 -2Learned counsel for the respondent does not dispute the fact with regard to above-said salary statement (Annexure P-6). After hearing the learned counsel for the parties, going through the record, this Court is of the considered view that order of revisional Court dated 06.08.2015 (Annexure P-1) requires to be modified. Accordingly, keeping in view the fact that the respondent-husband was getting net payable salary of `24,412/- per month as per salary statement (Annexure P-6), interim maintenance of `4,000/- is awarded to wife (petitioner No.1) and `3,000/- each to two minor children (petitioner Nos.2 and 3), from the date of filing of the application under Section 125 Cr.P.C. With the above-said observations, the present petition is allowed.
