Present writ petition is for quashing/modification of the order dated 10.05.2001 (Annexure P5) and for declaring Rule 53.3 of Punjab Civil Services Rules, Volume-II as violative of Articles 14, 16 & 21 of the Constitution of India.

Learned counsel for the petitioners contended that the matter in controversy is squarely covered as per the judgment rendered by the Hon'ble Apex Court in The State of Punjab & Another v. Mohinderjit Kaur (D) Th. L.R. (Civil Appeal No.4951/2009, decided on 17.08.2017). Learned counsel for the respondent has also not disputed this fact. In view of above, present writ petition stands disposed of in terms of the judgment rendered by the Hon'ble Apex Court in Mohinderjit Kaur's case (supra) and petitioners would be entitled to the family pension.
