(ORAL) This is a petition that has been filed for grant of regular bail to the petitioner in FIR No.381 dated 22.08.2019 registered under Section 6 of the POCSO Act and Section 376-C IPC at Police Station Sadar, Sonepat. Learned counsel for the petitioner herein would contend that the prosecutrix has been examined and she has not supported the version as set out in the FIR.

Whereas learned counsel apperaing on behalf of the respondent-State opposes grant of regular bail to the petitioner by contending that there is a video in which the young prosecutrix has narrated the entire incident that took place.

I have heard learned counsel for the parties and have perused the paper book. Keeping in view the fact that the prosecutrix is none other but the step daughter of the petitioner, who is alleged to have sexually abused the minor and there is also an MLR available on record, which does PANKAJ KUMAR 2021.07.02 15:21 I attest to the accuracy and integrity of this document

CRM-M No.23551 of 2021 (O&M) -2not rule out the possibility of sexual abuse, this Court does not deem it appropriate to grant bail to the petitioner. Consequently, the instant petition is dismissed. However, let an endeavour be made by the trial Court to conclude the trial as expeditiously as possible. Needless to state that any observations made herein are limited to the consideration of the bail application of the petitioner and shall not be construed as an opinion on merits of the case.
