**** Rajan Gupta, J. (Oral) This is a second petition under Section 439 Cr.P.C. seeking regular bail to the petitioner in a case registered against him vide FIR No.163 dated 04.11.2014 under Sections 302, 452, 326, 324, 323, 148 and 149 IPC at Police station Harike district Tarn Taran. According to learned State counsel out of 15 witnesses cited by the prosecution, 10 have been examined and 05 official witnesses remain to be examined. He further submits that prosecution shall endeavour that all the 05 remaining witnesses are examined on the next date of hearing. In view of the above, this court does not deem it fit to enlarge the petitioner on bail at this stage.

Dismissed.

The petitioner shall, however, be at liberty to file afresh, in case, trial court does not conclude the trial within a period of three months. This shall be subject to the condition that further proceedings are not delayed by the accused themselves.
