Petitioner has filed this petition under Section 438 Cr.P.C. for grant of anticipatory bail in case FIR No.193 dated 22.09.2015 under Sections 3/8, 2/80 of Cow Slaughter Act registered at Police Station Nagina, District Mewat.

Notice of motion was issued and learned State counsel appeared and contested the petition.

I have heard learned counsel for the petitioner as well as learned State counsel and have gone through the record. From the record, I find that FIR in the present case has been registered on the basis of secret information that petitioner Asgar is in the profession of cow slaughter and two bulls were taken VINEET GULATI 2015.12.21 13:00 I attest to the accuracy and authenticity of this document Chandigarh

CRM No.M-37368 of 2015 -2by him with intention to slaughter them in houses in front of Mosque. As per the allegations, two bulls were found lying on earth tied with ropes.

Learned counsel for the petitioner argued that the petitioner is not apprehended on the spot.

The petitioner has already joined the investigation. As per the prosecution version, only two bulls/cows have been recovered from the fields on the basis of secret information. The petitioner is not required for any investigation or interrogation purposes. The trial of the case will take long time. No useful purpose will be served by sending the petitioner to custody.

Keeping in view the facts and circumstances of the present case, I find it a fit case where the petitioner is entitled to benefit of anticipatory bail. Therefore, the present petition is allowed. The order dated 30.11.2015 granting interim bail to the petitioner is made absolute.
