State of Punjab .............Respondent CORAM: HON'BLE MR.JUSTICE JASWANT SINGH Present:- Mr.SK Passi,Advocate for the petitioner Mr.RS Randhawa,Addl.AG Punjab with ASI Zora Singh Jaswant Singh,J.(Oral) Prayer is for grant of regular bail in case FIR No.165 dated 12.09.2015 under Sections 22,61,85 of Narcotic Drugs and Psychotropic Substances Act,1985, PS Ghall Khurd,District Ferozepur. 22,440 intoxicant tablets were recovered from the possession of the petitioner.

It is submitted that the petitioner is running a Medical Store under the name and style of M/s Babe Ke Medical Store,Faridkot, Zira Road,Near Old Bus Stand,Talwandi Bhai.

Heard learned counsel for the parties.

At the time of hearing a custody certificate by way of affidavit of Surinder Singh,Superintendent,Central Jail,Ferozepur has been filed on behalf of the state,wherein it is stated that petitioner is in RAJINDER PRASHAD JOSHI 2015.11.18 17:29 I attest to the accuracy and authenticity of this document High Court, Chandigarh.

CRM-M 37385/2015 custody for the last 01 month and 23 days. It is further stated therein that petitioner was also convicted and sentenced on 24.9.2010 to undergo RI for 10 years and fine of Rs.1 lac by the learned Addl.Sessions Judge,Ferozepur in case FIR No.44 dated 15.4.2009 under Sections 22/61/85 of the NDPS Act in which he was released on bail on 16.10.2013.

In view of the heavy recovery and past conviction of the petitioner under the Narcotic Drugs and Psychotropic Substances Act,1985, no case for grant of regular bail is made out. Dismissed.
