**** ANOOP CHITKARA, J. (ORAL) Learned State counsel has opposed the present petition on the ground that a similar petition bearing CRM-M No. 9132 of 2022 was filed and it was withdrawn on 04.03.2022 without any liberty to file afresh. Learned counsel for the petitioner submits that he wants to withdraw the present petition with a liberty to the petitioner to surrender before the concerned Court and with a further prayer that he be released on interim bail on the date of surrender. Given the nature of the allegations, the prayer being innocuous is allowed. The present petition is disposed of having been withdrawn with liberty aforesaid.

It is clarified that in case, the petitioner surrenders before the concerned Court by 11 a.m., then the concerned Court shall release him on interim bail on the same date.

It shall be open for the petitioner to file a petition under Section 437/439 Cr.P.C.
