The petitioner is a student and has been in custody since 26.6.2012 in a case, which was registered at the instance of Ajay on the allegation that his brother Amit having been killed by the petitioner with a screw driver blows on the chest and back of the deceased. Irrespective of the nature of the allegations, the period of detention suffered by the petitioner is certainly a matter of concern but on asking of the court, learned State counsel informs that all the prosecution witnesses have been examined and the case is at the stage of recording defence evidence. In view of the said circumstances, without reference to the merits of the case, the petition is dismissed, expecting that the trial would be concluded within a period of 1/ 2 months by giving a fair opportunity to the petitioner to produce defence evidence.
