CRM-M No. 37453 of 2017 Petitioner Navjot Lehal, by way of filing the present petition seeks transfer of challan with respect to F.I.R. No. 268 dated 30.11.2014 under Sections 342, 354-A, 509, 506 and Section 34 IPC registered with Police Station Samrala, District Khanna presently pending before SDJM, Samrala to any other Court in District Mohali. CRM-M No. 37453 of 2017 (O&M) of petition was given to respondents, who have put in appearance. Learned State counsel has controverted the allegations against the police officers/officials whereas counsel appearing for respondents no. 2 to 4 has vehemently refuted and denied the allegations against the private respondents and other officers/officials of LIC. After hearing the petitioner, learned State counsel and learned counsel for respondents no. 2 to 4, I find that keeping in view the fact that petitioner is a woman and she has old aged parents to look after and it would be difficult for her to travel from Mohali to Samrala to attend the dates of hearing in the Court of SDJM at Samrala, her request for transfer of case deserves to be considered sympathetically.

As regards the allegations levelled by her against the private respondents and various police officers/officials those are certainly uncalled for with respect to moving the present petition and need not be looked into. Under the circumstances, the petition is accepted and case in question is ordered to be withdrawn from the Court of SDJM Samrala and is transferred to the Court of Chief Judicial Magistrate, Chandigarh for disposal in accordance with law. The parties are directed to appear in the transferee Court on 20.9.2018. The petition stands allowed accordingly. (H.S.
