(Oral) The petitioner herein seeks the relief of regular bail in the criminal case arising out of the FIR bearing No.29 dated 10.02.2021 registered at Police Station Haibowal, District Ludhiana, under Sections 341, 323, 506, 148, 149 IPC wherein the offences under Sections 325 and 307 IPC are stated to have been added later-on. Bereft of unnecessary details, the allegations as levelled by the complainant-Amandeep Singh in the subject FIR are that the petitioner and his co-accused caused injuries to his brother named Sandeep Singh with weapons like kirpan, bricks, iron rod etc. Reply on behalf of the respondent-State, by way of the POOJA SHARMA 2022.03.07 16:27 I attest to the accuracy and authenticity of this document

CRM-M No.23318 of 2021 -2affidavit of ACP (West), Ludhiana, is already available on the file and the same is taken on the record.

I have heard learned counsel for the petitioner as well as learned State counsel in the instant petition and have also perused the file thoroughly.

Learned counsel for the petitioner contends that the petitioner is behind the bars since 06.05.2021 and he is not involved in any other criminal case of the similar nature and that the Challan has already been presented in the Court and the Charges have also been framed in this case and in these circumstances, the petitioner deserves the relief as prayed for in this petition.

Learned State counsel does not dispute the afore-referred factual position.

Keeping in view the above-discussed facts and circumstances as well as the fact that the trial of the case is likely to take sufficient time to conclude and without commenting or expressing any opinion on the merits of the case, the petitioner named Inderdeep Singh @ Inderjit Singh @ Franky is ordered to be released on regular bail subject to his furnishing the requisite personal and surety bonds to the satisfaction of learned trial Court/Chief Judicial Magistrate/ Duty Magistrate concerned.
