This is a petition filed under Section 438 of the Code of Criminal Procedure seeking pre-arrest bail in a case registered against the petitioners vide FIR No. 139 dated 29.06.2017 under sections 323, 324, 506, 148, 149, 326 IPC at Police Station Cheeka.

Learned State counsel submits that main injury attracting offence under section 326 IPC which led to amputation of little and fifth toe of right toe is attributed to petitioner no. 1. In view of nature of injuries attributed to petitioner no. 1, he is not entitled to concession of pre-arrest bail. Petition is dismissed qua petitioner no. 1-Kali Ram. As regard petitioner no. 2, he is stated to have joined investigation and is not required by the investigating officer. In view of the above, order dated October 06, 2017 is made absolute qua petitioner no. 2-Dilbag subject to the conditions envisaged under Section 438(2) Cr.P.C.
