PANKAJ JAIN, J. (ORAL) This petition has been filed under Section 439 Cr.P.C. for grant of regular bail to the petitioner in case FIR No.0113 dated 31st July, 2021 registered for the offences punishable under Sections 379-B(2)/34 of the IPC, 1860, at Police Station Verka, District Police Commissionerate Amritsar.

Ld. Counsel for the petitioner submits that the petitioner is in custody since 31st of July, 2021. Challan already stands presented and the Charges have been framed. Co-accused namely Lovejit Singh has already been granted concession of regular bail by a Co-ordinate Bench of this Court in CRM-M No.2131 of 2022 vide order dated 16th of March, 2022. 4.

Ld. State Counsel is not in position to show that the role attributed to the petitioner is in any way different from that of the coaccused Lovejit Singh. 6.

Owing to the fact that the petitioner is facing incarceration since 31st of July, 2021 and the co-accused already stands admitted to regular bail, the petitioner is held to be entitled for concession of regular bail. Accordingly, without commenting on the merits of the case, the present petition is allowed. The petitioner is ordered to be released on regular bail on his furnishing bail/surety bonds to the satisfaction of the trial Court/Duty Magistrate, concerned.
