Mr. Deepak Sabherwal, Advocate and Ms. Ruchika Sabherwal, Advocate for the respondents-HSVP *** PANKAJ JAIN, J. (ORAL) Short reply by way of affidavit of Manav Malik, Estate Officer, HSVP, Panchkula on behalf of respondents has been filed. The same is taken on record.

On 13.08.2025 the following order was passed :- "The petitioner alleges willful disobedience of the order dated 04.09.2018 passed in CWP No.16352 of 2018.

Counsel for the respondents however submits that though the notices were withdrawn owing to a digital error, however the fresh notice was issued in view of the statement as recorded in the said order. Pursuant to such notices, the petitioner has also availed RESSS-2024 and as on date, there is no dispute with respect to any pending amount as the dues are nil. Mr. Sabharwal prays for time to place on record notices issued after order dated 04.09.2018.

On his request, adjourned to 01.09.2025."

The operative part of the reply reads as under :- "4. That Vivadon Se Samadhan Scheme (VSSS) 2024 has been launched by HSVP for availing the benefits of enhancement compensation which is valid for 6 months ie. dated 15.11.2024 to 14.05.2025 & further extended upto 30.06.2025. The copy of scheme with terms and conditions are attached herewith as Annexure-R-1. In VSSS-2024 scheme at serial no. 11 specifically it is mentioned that:- "Participation in the scheme is voluntary. Allottees availing of the scheme must agree to resolve all disputes related to additional price demands. They must also provide an unconditional undertaking to withdraw any related litigation and agree not to contest future calculations. Without this undertaking, the allottee will be considered to have opted out of the scheme."

5. That the petitioner society was informed vide letter memo no. 9246 dated 17.12.2024. That:- "It is informed hereby that the VSSS Scheme 2024has been launched by HSVP for availing the benefits of enhancement compensation which is valid for 6 month ie. dated 15.11.2024 to 14.05.2025. Furthermore, the above said Group Housing is falling under this Scheme where you may avail the benefit under Enhancement as per VSSS Scheme the total outstanding for Rs. 27,25,098/-out of which rebate will be for Rs.

60,032.62/- and the amount payable for Rs.

26,65,065.38/as on 10.12.2024 against your Society subject to audit. You are therefore requested to apply for getting the rebate in the office at earliest. So that long pending disputes may be settled and litigation (if any) may be closed." Copy of the letter dated 17.12.2024 is attached as Annexure-R-2.

6. That the petitioner has availed the benefits of scheme i.e. VSSS2024 and paid due amount under scheme therefore no issue remains in respect of Enhanced compensation amount."

Counsel for the petitioner does not dispute that in view of the stand taken by respondents, no further order is required to be passed in the present contempt petition.

Contempt petition stands disposed off.

Rule discharged.
