******* SURINDER GUPTA, J.(Oral) The present petition has been filed under Section 438 Code of Criminal Procedure for grant of anticipatory bail to the petitioner in case FIR No.61 dated 22.04.2016 registered for the offence punishable under Section 21 of Narcotic Drugs and Psychotropic Substances Act, 1985, at Police Station Mehatpur, District Jalandhar Rural. Heard.

Learned counsel for the petitioner submits that petitioner had been regularly appearing before the trial Court but could not appear on 19.05.2017 and his absence on that day was not intentional. Now, the petitioner has appeared before the trial Court and has been allowed interim bail in terms of order dated 06.10.2017.

Keeping in view the fact that petitioner has surrendered before the trial Court and has been allowed interim bail, but without expressing any opinion on the merits of the case, this petition is allowed and order dated 06.10.2017 is made absolute subject to the condition that petitioner will keep on appearing on each and every date of hearing. In the event of his non-appearance on any date without permission, the trial Court will be competent to cancel his bail and forfeit the bail bond and surety bond and proceed against him in accordance with law.
