CRM-M-18957-2020 Jaspreet Kaur vs. State of Punjab CRM-M-19249-2020 Amandeep Kaur vs. State of Punjab and others Present:- Mr.Tejwinder Singh Gill, Advocate, for the petitioner (CRM-M-18957-2020) Mr.G.S.Jattana, Advocate for Mr.A.S.Brar, Advocate, for the petitioner (CRM-M-19249-2020) Mr.Prabhjot Singh Walia, AAG, Punjab.

****** All cases listed today have been taken up for hearing by way of video conferencing because of the situation existing due to the Covid-19 pandemic.

CRM-M-18957-2020 Pursuant to the order dated 16.07.2020, learned State counsel, on instructions, submits that the petitioner has joined investigation and presently at least her custodial interrogation is not required. Consequently, this petition is disposed of, with the order admitting the petitioner to interim anticipatory bail on 16.07.2020, made absolute on the same terms and conditions.

CRM-M-19249-2020 By this petition the prosecutrix in the case seeks directions to the official respondents to immediately arrest respondents no.5 to 8, with respondent no.8 in this petition being the petitioner in CRM-M-18957-2020, who was earlier admitted to interim pre-arrest bail by this court with that order made absolute hereinabove.

Learned counsel for the petitioner submits that as regards respondent no.8, he does not press the petition for her arrest but as regards

CRM-M-18957-2020 -2CRM-M-19249-2020 respondents no.5, 6 and 7, he is still pressing the petition (who otherwise are residing in the USA).

Very obviously, in this time of the Covid epidemic, it would be slightly difficult to go to the USA and obtain arrest warrants to arrest the said respondents (unless they come to India and actually their arrest is required by the investigating agency); however, learned counsel submits that infact the petitioner, i.e. the prosecutrix, is being pressurised to compromise the matter with the said respondents.

Without making any comment on the actual merits of the case, even on that contention raised hereinabove, notice of motion is consequently issued to respondents no.1 to 3 at this stage, with Mr.Prabhjot Singh Walia, AAG, Punjab, accepting notice at the asking of the court. In fact, though notice of motion had not been issued in this petition on the last date of hearing, however, a reply to the petition has already been filed by the DSP, Nihal Singh Wala, District Moga, on behalf of respondents no.1 to 3.

However, a copy thereof not having been given to learned counsel for the petitioner, the learned State counsel would ensure that the same is supplied to learned counsel for the petitioner by e-mail, today itself. Adjourned to 07.09.2020.

A photocopy of this order be placed on the file of the connected case.
