Offence u/s 326 IPC having been added in the charges, the petitioners apprehending arrest have filed the present petition for pre-arrest bail.

Pursuant to the interim order, the petitioners have joined the investigation in the added offence u/s 326 IPC. Since the incident pertains to the year 2011 and challan has already been presented, it will not be prudent to send the petitioners in custody on amendment of charge. The petition is allowed. It is ordered that in the added offence u/s 326 IPC, the petitioners will be released on bail by the trial court to its satisfaction, subject to the condition that they will not tamper with evidence or brow beat the witnesses.
