**** HARSIMRAN SINGH SETHI , J. (ORAL) Petitioners have approached this Court seeking stepping up of their pay equivalent to that of their junior, namely, Ms. Dimple, who was promoted in preference to them by granting her the benefit of reservation. The service details of the petitioners and that of Ms. Dimple given in paragraph No.6 of the writ petition to show that petitioners were seniors to said Ms. Dimple, who got promoted as a Senior Assistant on the basis of reservation.
In order to seek the benefit, reliance is being placed by the petitioners on the instructions issued by the Government of Punjab dated 14.03.2017 (Annexure P-1), which have already been adopted by the respondent University, vide resolution dated 23.12.2017 (Annexure P-2). CWP-10695-2019 -2the respondents with a legal notice on 12.11.2018 (Annexure P-8), which is still pending consideration with the respondents. Interest of justice will be served, at this stage, in case a time bound direction is issued to the respondents to decide the said legal notice by passing an appropriate speaking order.
Without expressing any opinion on the merits of the case or the claim being made by the petitioner in the present petition, the respondents are directed to decide the legal notice dated 12.11.2018 (Annexure P-8) by passing the appropriate speaking order within a period of three months from the date of receipt of a certified copy of this order. In case after the decision, it is found that the petitioners are entitled for any monetary benefit, the same shall also be released to them within a period of next three months.
Present writ petition stands disposed of.
