(Oral) Quashing of FIR No. 91 dated 15.05.2014 under Sections 408/465/468/471 IPC, registered at P.S. Divn. No. 5, Ludhiana, is being sought on the basis of compromise dated 28.05.2014 (Annexure P-4). F.I.R has been registered on the statement of respondent No. 2 against the petitioners alleging that petitioner No. 1 is the employee of respondent No. 2 and the petitioners in connivance with each other, embezzled an amount of Rs.22,30,000/- from the firm of respondent No. 2.

During the pendency of the investigation, the matter stands compromised between the parties, vide compromise deed dated 28.05.2014.

In compliance of order dated 04.11.2014, report of District and Sessions Judge, Ludhiana has been received in this regard. As per report, statement of complainant-Rishi Jain has been recorded to the effect that he had compromised the matter with the accused persons and has no grudge against him. Crl. Misc. No. M-37596 of 2014 (O&M) -2Arora, Deepak Grover and Rahul Kataria has been recorded to the same effect. The compromise has been entered voluntarily and without any pressure.

Consequently, in view of the status report and in view of the judgment of the Hon'ble Supreme Court in the case of Madan Mohan Abbot vs. State of Punjab 2008(2) RCR (Criminal) 429, the law laid down by the Full Bench of this Court in the case of Kulwinder Singh and Ors. vs. State of Punjab and another 2007(3) RCR (Crl.) 1052, no useful purpose would be served in prolonging the litigation. Accordingly, FIR No. 91 dated 15.05.2014 under Sections 408/465/468/471 IPC, registered at P.S. Divn. No. 5, Ludhiana, are quashed with all consequential proceedings arising therefrom qua petitioners.

The petition stands disposed of.
