The petitioner being one of the members of unlawful assembly had allegedly assaulted Makhan Singh complainant after chasing him as he was urinating out side his house and that there existed a dispute regarding drain water between the parties. Three co-accused of the petitioner have already been arrested. The petitioner has joined the investigation.

Taking into consideration the fact that no grievous injury is attributed to the petitioner, the petition is allowed and it is ordered that in case of arrest of the petitioner, he will be released on bail to the satisfaction of the arresting officer subject to the condition that the petitioner will join the investigation as and when required by the police and will not tamper with evidence or hamper the investigation. The petitioner will not commit the similar offence, of which he is accused of, during pendency of the trial.
