Petitioner seeks concession of regular bail in a case registered against him under sections 21, 29 of the NDPS Act vide FIR No. 72 dated 17.08.2017 at police station Khalra, district Tarn Taran. Learned counsel for the petitioner submits that alleged recovery from the petitioner was 12 grams of heroin which is non-commercial in nature. Co-accused Gurvinder Singh @ Sonu has already been granted the concession of bail by this court in CRM M-43371 of 2017. Thus, petitioner deserves to be enlarged on bail. Learned State counsel does not dispute the quantity of contraband recovered from the petitioner.
Admittedly, petitioner is in custody since 20.08.2017 and coaccused has already been granted the concession of bail. Without expressing any opinion on the merits of the case, this court feels that petitioner deserves to be enlarged on bail.
