(Oral) The present Civil Writ Petition has been filed under Articles 226/227 of the Constitution of India, inter alia, seeking issuance of a writ in the nature of Certiorari for quashing the order dated 27.04.2021 (Annexure P-3) passed by learned District Collector, Ferozepur, whereby the matter as regards appointment of Lambardar of Village Chak Somian Wala has been forwarded to concerned Sub Divisional Magistrate with a direction to get fresh mushtari munadi (proclamation) conducted in the village and call for applications from desirous/eligible candidates and after completing the formalities, the file be put up before his Court. 1.1 A further prayer has been made for setting aside the order dated 11.07.2024 (Anneuxre P-4) passed by respondent No. 3 and also the order dated 23.09.2024 (Anenxure P-7) passed by respondent No. 2; whereby, an appeal and revision filed by the petitioner against Collector's order were dismissed, respectively.

After arguing for some time, learned counsel for the petitioner submits that he may be permitted to withdraw the present civil writ petition. However, he submits that as per order dated 27.04.2021 (Annexure P-3) passed by the learned Collector, the matter was referred to the Sub Divisional Magistrate for carrying out a fresh proclamation/mushtari munadi regarding the appointment of Lambardar of Village Chak Somian Wala, Tehsil Guruharsahai, District Ferozepur, however nothing has been done till date. Therefore, appropriate directions be issued in that regard. 3.

In view of the aforesaid stand taken by learned counsel for the petitioner, the present writ petition is dismissed as withdrawn. However, in case the fresh proclamation, in pursuance of the order dated 27.04.2021 (Annexure P-3) passed by the learned Collector, Ferozepur, has not already been carried out, the same shall be completed within a period of one month from today, and the proceedings for appointment of Lambardar of Village Chak Somian Wala, Tehsil Guruharsahai, District Ferozepur shall be concluded within a period of six months thereafter (if not already done so). 4.

It is made clear that in case, the proceedings as regards appointment of Lambardar of Village Chak Somian Wala, Tehsil Guruharsahai, District Ferozepur have already being carried out then this order shall be of no effect and avail.

All pending application(s), if any, stand disposed of accordingly.
