Instant petition has been filed under Article 227 of the Constitution of India inter alia for setting aside impugned order dated 16.04.2023, Annexure P-9, passed by learned Sole Arbitrator, whereby, application, Annexure P-7, filed by the respondents for restoration of Arbitration claim, which already stood dismissed as withdrawn vide order dated 07.02.3032, Annexure P-5, has been allowed, and the claim has been restored.

Upon instructions from the petitioners, counsel for the petitioners submits that the dispute has been amicably settled between the parties on 20.02.2024, before the Mediation and Conciliation Centre of this Court, and on the basis of the settlement, an Award dated 20.02.2024, has been passed by the learned Arbitrator. He submits that the petition as well as Misc. Application has become infructuous. 3.

Dismissed as having been rendered infructuous. 4.
