(Oral) This is a petition filed under Section 439 of the Code of Criminal Procedure seeking regular bail in a case registered against the petitioner vide FIR No16 dated 16.02.2017 under Sections 15 of the NDPS Act, at Police Station Kotbhai, District Sri Muktsar Sahib. Learned counsel for the petitioner contends that recovery of 60 Kg. of poppy husk, which is marginally above commercial quantity. He further contends that there is no other case pending against the petitioner. Learned State counsel has opposed the prayer. In view of the above, I find that no useful purpose will be served in continuing the detention of the petitioner. Keeping in view the facts and circumstances of the case and without making any observation on the merits of this case, the petition is allowed and the petitioner is ordered to be released on bail, subject to the satisfaction of the concerned trial court/Illaqa Magistrate.
