CHANDIGARH CRM M-37555 of 2015 Date of decision : 17.05.2016 Balkar Singh ....Petitioner V/s State of Punjab & ors.

....Respondents BEFORE : HON'BLE MR. JUSTICE RAJAN GUPTA

Present:

Mr. Jagjit Singh, Advocate for the petitioner. Mr. Ankur Jain, AAG Punjab.

RAJAN GUPTA J.

Present petition is directed against the order passed by trial court whereby application moved by prosecution under section 311 Cr.P.C. has been dismissed. All witnesses have been examined in the matter and trial is nearing culmination. At this stage, an application has been moved for producing the enquiry report and to summon the official witness who conducted the enquiry. Prayer has been rejected by the court below observing that entire material which was collected by the investigating agency is already on record. It found that statements of the witnesses recorded during enquiry are not essential for just decision of the case. I find no infirmity with the order. Pursuant to final report submitted by the investigating agency, prosecution witness has been examined and case is now fixed on 23.05.2016 for arguments. There is no ground to interfere in revisional jurisdiction. Dismissed.
