Prayer made in the present petition is for directing the respondents to grant the benefit of step up and fix the pay of the petitioner at par with his junior.

Learned State counsel refers to the preliminary submissions Nos.1 and 2 of the reply filed on behalf of respondent Nos.1 and 2, wherein it has stated that the Govt. instructions dated 21.06.2000, Annexure R-1, are applicable to those junior and senior govt. employees who belong to the same cadre and the posts in which they had been appointed/promoted should also be identical and in the same cadre, whereas, the petitioner and respondent No.3 with whom, he was demanding equation of pay were recruited in different cadre and thus the claim of the petitioner is not tenable. Further, reference is made to para 7 and 8 of the additional affidavit filed by Deputy Director, Department of Technical Education and Industrial Training Punjab, to which, there was no rebuttal by filing any replication. 3.

In view of the above, the present petition is disposed of, reserving the petitioner with a liberty to get it revived, in case lis still survives.
