Learned counsel for the petitioner submits that the complainant is carrying on dairy business, where the petitioner had been supplying milk. The dispute was over the payment of milk supplied to the complainant, which has been given shape of occurrence alleged to have taken place on 26.11.2013. The FIR was registered on 28.11.2013 without explaining the delay.
Learned State counsel submits that during investigation by the police, no evidence has come on record that the petitioner was supplying milk to the complainant, rather petitioner was purchasing some SACHIN MEHTA 2015.05.04 09:53 I attest to the accuracy and authenticity of this document Chandigarh
CRM-M-37686-2014 -2dairy products of the complainant and there was some dispute regarding the payment of those products.
The injury on the person of mother of complainant were found simple in nature. The petitioner has joined the investigation and is on interim bail.
Keeping in view the above facts but without commenting on the merits of the case, this petition is allowed and the order of interim bail dated 26.11.2014 is made absolute, till the presentation of challan, subject to the following terms:- (i) that the petitioner shall make himself available for interrogation by the police as and when required; (ii) that the petitioner shall not, directly or indirectly, make any inducement, threat or promise to any person acquainted with the facts of the accusation against him so as to dissuade him from disclosing such facts to the Court or to any police officer;
(iii) that the petitioner shall not leave India without the prior permission of the Court.
(iv) that the petitioner will seek regular bail on the presentation of challan in Court.
