IN THE HIGH COURT OF PUNJAB AND HARYANA

AT CHANDIGARH CRM-M-21498-2022 Date of Decision:-23.05.2022 TARUN SINGH ... Petitioner

Versus

STATE OF HARYANA ... Respondent *****

CORAM:

HON'BLE MR. JUSTICE KARAMJIT SINGH ***** Present:- Mr. Vijay, Advocate for Mr. Baljeet Beniwal, Advocate for the petitioner.

***** KARAMJIT SINGH , J. (Oral) The petitioner has approached this Court seeking grant of regular bail in a case having FIR No.67 dated 7.12.2021 registered under Sections 419, 420, 120-B, 201 IPC at Police Station Cyber Crime, District Faridabad.

Counsel for the petitioner contends that initially the petitioner was not named in the FIR, but later on nominated and is in custody since 20.1.2022. The counsel further contends that the after investigation, challan has been presented and co-accused has already been granted interim anticipatory bail by this Court vide order 24.2.2022 (Annexure P-4). GAURAV SOROT 2022.05.23 18:47 I attest to the accuracy and authenticity of this order/judgment

( 2 ) CRM-M-21498-2022 Notice of motion.

On the asking of the Court, Ms. Harpreet Kaur, AAG, accepts notice on behalf of State of Haryana and on instructions from SI Babu Ram has not controverted the fact regarding custody period of the petitioner as well as the fact that he was not named in the FIR and the fact that challan has been presented on completion of investigation and grant of interim anticipatory bail to the co-accused.

It will take considerable time for the trial to conclude. Thus, no useful purpose would be served by keeping the petitioner behind the bars for an indefinite period. Thus without commenting on the merits of the case, the petition is allowed and the petitioner is ordered to be released on bail subject to his furnishing bail and surety bonds to the satisfaction of the trial Court/CJM/Duty Magistrate concerned.
