NAMIT KUMAR J. (Oral) Prayer in this writ petition filed by the petitioner under Articles 226/227 of the Constitution of India, is for issuance of a writ in the nature of certiorari, for quashing the order dated 24.02.2022 (Annexure P-6) whereby three annual grade increments of the petitioner were stopped in view of punishment order dated 12.09.2019 (Annexure P-3) set-aside by the Appellate Authority respondent No.1 vide order dated 23/24.09.2021 (Annexure P-5), by the Board of Directors. Further prayer has been made to release the accrued benefits after restoring three annual grade increments against which recovery has already been made along with interest @ 18%.

CWP No.10749 of 2022 (O&M) Learned counsel for the respondents submits that the appeal filed by the petitioner against the impugned punishment order dated 12.09.2019 (Annexure P-3) is under consideration and decision on the said appeal shall be taken within a period of two months from today and necessary order shall be passed.

In view of the statement of learned counsel for the respondents - Markfed, the instant petition has been rendered infructuous.

Needless to mention here that if the order of the Appellate Authority is against the petitioner, she shall be at liberty to challenge the same along with punishment order.
