Present petition under Section 438 Cr.P.C. for seeking pre-arrest bail to the petitioner(s) in case FIR No. 55 dated 25.5.2015, registered under Section(s) 452, 323, 324, 326, 307, 506, 148 & 149 IPC at Police Station Sadar, Sri Muktsar Sahib.

Learned counsel for the petitioners contended that the present case is a version and cross-version and petitioners have separately filed a complaint under Section 326 IPC as well and summoning order was passed against the opposite party. Learned counsel further contended that the injuries attributed to the petitioners are not attracting the provisions of Section 307 IPC. Both the petitioners have already been declared innocent by the police during investigation and they were summoned on an application under Section 319 Cr.P.C. Criminal Misc. No. M-37658 of 2017 also submitted that petitioners are ready to join the investigation Learned counsel for the respondent-State affirmed the fact, on the basis of instructions of Guriqbal Singh, Assistant Sub Inspector, that both the petitioners were found innocent during investigation and they were summoned on an application under Section 319 Cr.P.C. In view of above, present petition is disposed of with the direction that petitioners shall appear before the learned trial Judge on the date fixed i.e. 1.12.2017 and the learned Court below shall consider their application for grant of bail by passing an appropriate order thereon.
