(Oral) Learned counsel for the petitioner prays for withdrawal of the present petition to enable the petitioner to challenge the summoning order, dated 14.1.2013, passed by learned Trial Court before the Court of Session by way of criminal revision petition, in accordance with law Learned counsel for the respondent has no objection to the above prayer.

CRM-M-37705-2014 (O&M) present petition is disposed of with permission to the petitioner to file criminal revision petition before the Court of Session at the first instance.

It is directed that in the event the petitioner prefers criminal revision petition within three weeks of passing of this order alongwith an application under Section 5 of the Limitation Act, 1963, for condonation of delay in filing criminal revision petition, the application shall be considered sympathetically in view of the fact that the petitioner has approached this Court by way of present petition.
