(Oral) The instant petition has been filed under Section 439(2) of the Code of Criminal Procedure (for short, 'the Cr.P.C.') for cancellation of anticipatory bail granted to respondent Nos.2 5, vide order dated 17.09.2016, in FIR No.82 dated 20.08.2016, registered under Sections 361, 364-A, 365, 454 and 120-B of the Indian Penal Code, at P.S. Nurpur Bedi, Distt. Rupnagar.

It is contended that respondent no.3 is a practicing lawyer at District Courts at Anandpur Sahib and Rupnagar. The minor daughter of the petitioner is yet to be recovered from the private respondents. Heard.

The instant petition for cancellation of anticipatory bail granted to respondent Nos.2 to 5, has been filed stating various reasons which relate Sanjay 2016.11.23 18:36 I attest to the accuracy and integrity of this document

CRM-M-38534-2016 -2to the merits of the case, which this Court is not inclined to probe at this stage. There is nothing on record to suggest that the accused-respondents have ever abused or misused the concession of anticipatory bail granted to them by the learned Court below. The grounds raised for cancellation of bail are essentially factual and shall be gone into by the trial Court at appropriate stage.

In this view of the matter, the instant petition is hereby dismissed.

Dismissed.
