Petitioners have filed this petition under Section 438 Cr.P.C. for grant of anticipatory bail in case FIR No.96 dated 08.06.2015 under Sections 363, 366 and 120-B IPC, registered at Police Station Sultanpur, District Kapurthala. Notice of motion was issued and learned State counsel appeared and contested the petition. Learned counsel for respondent No.2 also appeared.

I have heard learned counsel for the parties as well as learned State counsel and have gone through the record. From the record, I find that in the present case the FIR has VINEET GULATI 2015.12.19 15:11 I attest to the accuracy and authenticity of this document Chandigarh

CRM No.M-37652 of 2015 -2been registered on the statement of Kulwant Kaur under Sections 363, 366 and 120-B IPC regarding abducting respondent No.2 by petitioner No.2 Manpreet Singh alias Soni for the purpose of marriage. It has been brought to the notice of this Court that respondent No.2 is residing with petitioner No.2 as his wife in his house. Also, an order has been placed on the record passed in the petition filed by Ramandeep Kaur and Manpreet Singh alias Soni seeking protection from this Court. As per the police investigation also, Ramandeep Kaur is residing with Manpreet Singh as his wife as they have performed the marriage.

The trial of the case will take long time. No useful purpose will be served by sending the petitioners to custody. Keeping in view the facts and circumstances of the present case, I find it a fit case where the petitioners are entitled to benefit of anticipatory bail. Therefore, the present petition is allowed. The order dated 05.11.2015 granting interim bail to the petitioners is made absolute.
