The petitioner has filed this petition under Section 439 Cr.P.C. for grant of regular bail in case FIR No.15 dated 9.2.2014 (Annexure-P.1) registered for the offences under Sections 364, 365, 384, 420, 342 and 120-B IPC at Police Station Khizrabad, District Yamuna Nagar.

Notice of motion has been issued in this case. Mr. Deepak Grewal, learned Deputy Advocate General, Haryana has put in appearance on behalf of the respondent-State and contested this petition.

I have heard learned counsel for the petitioner and learned Deputy Advocate General, Haryana appearing for the respondent-State HARPAL SINGH PARMAR 2015.01.09 16:42 I attest to the accuracy and authenticity of this document Chandigarh

Cr. Misc. No.M-37746 of 2014 [2] and have gone through the record.

As per the prosecution version, the FIR has been got registered by Surender Kaur-complainant. The main allegation against the present petitioner is that he along with his co-accused conspired and got executed an agreement to sell and thereafter sold 25 Kanals 17 Marlas of land of Gurmeet Singh fraudulently, who is stated to be mentally retarded person without paying him any consideration amount. The challan has already been presented. The petitioner is in custody since 21.9.2014 and the trial of the case will take long time. The petitioner is not required for interrogation or investigation purposes. No useful purpose will be served by keeping the petitioner in custody till the final disposal of the case.

Therefore, keeping in view the facts and circumstances of the present case, this criminal miscellaneous petition is allowed and the petitioner is ordered to be released on bail subject to his furnishing personal bond in the sum of `50,000/- with one surety in the like amount to the satisfaction of the trial Court/Duty Magistrate. January 9, 2015.
