Through this petition filed under Section 438 Cr.P.C., the petitioner seeks the grant of anticipatory bail in FIR No. 6 dated 05.01.2016, registered under Sections 307, 326, 325, 34 IPC and Sections 25, 27, 54, 59 of the Arms Act, at Police Station Sadar Tarn Taran, District Tarn Taran. While issuing notice of motion on 06.02.2017, this Court had granted ad-interim anticipatory bail to the petitioner, subject to his joining investigation and conditions envisaged under Section 438(2) Cr.P.C. Seeking anticipatory bail for the petitioner, learned counsel submits that after investigation, the petitioner was found innocent and has been summoned to face trial under Section 319 Cr.P.C.; since the trial is on, the petitioner is not needed for investigation purposes; no recovery is also to Monika 2017.03.08 17:18 I attest to the accuracy and integrity of this document

Crl. Misc. No. M-3771 of 2017 be made from the petitioner and under the interim order of this Court, the petitioner has dutifully appeared before the trial court on 14.02.2017 and on such appearance, on the satisfaction of the trial court, has been admitted to bail.

After considering the above submissions, the petition is allowed and order dated 06.02.2017 granting ad-interim anticipatory bail to the petitioner is made absolute.

Nothing observed herein above shall be considered to be an expression of opinion by this court on the merits of the case. If the petitioner is found indulging in any other criminal act or misusing the concession of bail granted by this Court, it would be open to the State to seek cancellation of bail granted through this order by filing an appropriate application before the competent Court/this Court.
