In the present petitions, the recovery order of the amount paid to the petitioners vide letters dated 09.05.2007, Annexure P-5, were stayed on 06.11.2007 and 21.09.2007 respectively by noting that " Petitioner retired from service on 30.11.2002, and granted pension, which was sought to be withdrawn in view of the subsequent instructions issued on 05.03.2007" and that prima facie, there was no allegation of misrepresentation and fraud on the part of the petitioner is alleged.

stood disposed of on 17.11.2008, based on the judgment passed in Rakha Singh vs. State of Punjab and Others, CWP-7780-2004, decided on 27.01.2005, against which no LPA was filed, which fact learned State counsel despite best efforts has been unable to controvert and resist disposal of the petition in terms thereof or cite any contrary law 4.
